FAB9 Membership Pack

Fab9 Pty Ltd operates the Fab9 Makerspace located at 90 Maribyrnong Street, Footscray, VIC 3011. We permit our members access to the Makerspace to use our workspace, equipment and services.    

The Membership Agreement

The Membership Agreement is comprised of the Membership Particulars, Terms & Conditions and our Membership Plans & Fee Schedule. It sets out the terms and conditions applicable to your Fab9 Membership.
When you sign the Membership Agreement, you are entering into a legally binding agreement with Fab9.

Key details about your Membership
Your Membership will start on the Start Date and automatically extend on a month-to-month basis, until either you, or we, terminate it in the way described in the Membership Agreement.
If an automatic direct debit arrangement is in place, Membership Fees will be debited from your card or account in advance on monthly basis until we or you suspend or cancel the arrangement by notifying your bank or credit provider.
The Membership Agreement sets out the process for you to temporarily suspend your Membership and obligation to pay the Fees.

Risks
There are risks associated with use of our workspace and equipment. This includes risk of physical harm or personal injury including permanent disability and/or death. any such injury can result not only from your actions but from the actions, omission or negligence of others.

Deposit

TERMS & CONDITIONS

A   DEFINITIONS & INTERPRETATION

A.1 Definitions

  • ABN means Australian Business Number.
  • Agreement means this membership agreement including itsParticulars, Terms and Conditions and Membership Plans & Fees Schedule (as may be amended from time to time).
  • Business Day means a day (other than a Saturday, Sunday or publicholiday) on which banks are open for general banking business in Melbourne,Australia
  • Deposit has the meaning given in the Particulars.
  • Equipment means all machines, tools, systems and resources make available to the Member at the Premises.
  • Fees means all fees and chargeable payable by the Member under this Agreement and includes all fees referred to in clause E and the Schedule.
  • General Conditions means the provisions set out in the section of this Agreement entitled "General Conditions".
  • GST has the same meaning as in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  • Membership has the meaning given in clause C.2.
  • Membership Fee means the monthly fee payable by the Member in accordance with their Membership Plan.
  • Membership Plan has the meaning given in clause C.1.
  • Particulars means the provisions set out in the section of this Agreement entitled "Particulars".
  • Payment Services Provider has the meaning given in the Particulars.
  • Premises means the premises located at 90 Maribyrnong Street, Footscray in the state of Victoria.
  • Special Equipment has the meaning given in Part C of the Schedule.
  • Schedule means the Membership Plans and Fees Schedule set out in the Schedule to this Agreement, or available on the Website, as amended from time to time.
  • Services means provision of access to the Workspace, Equipment and related services.
  • Training and Assessment Fees means fees payable to Fab9 for the provision of training or assessment in the use of specific Equipment within the Workspace.
  • Tax Invoice has the same meaning as in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  • Workspace means such parts of the Fab9 Makerspace as are made available to Members in accordance with the terms of their Membership Plans.

A.2 Interpretation

  • The singular includes the plural and the opposite also applies.
  • If a word or phrase is defined, any other grammatical form of that word or phrase has a corresponding meaning.
  • A reference to a clause refers to clauses in this Agreement.
  • A reference to legislation is to that legislation as amended, re-enacted or replaced, and includes any subordinate legislation issued under it.
  • Mentioning anything after includes, including, or similar expressions, does not limit anything else that might be included.
  • A reference to a party to this Agreement or another agreement or document includes that party's successors and permitted substitutes and assigns (and, where applicable, the party's legal personal representatives).
  • A reference to a person, corporation, trust, partnership, unincorporated body or other entity includes any of them.
  • A reference to information is to information of any kind in any form or medium, whether formal or informal, written or unwritten, for example, computer software or programs, concepts, data, drawings, ideas, knowledge, procedures, source codes or object codes, technology or trade secrets.
  • A reference to dollars or $ is to an amount in Australian currency.
  • Headings are only for convenience and do not affect interpretation.

B   TERM

B.1 Term

This Agreement commences on the Start Date and continues in force until it is terminated by you or us in accordance with its terms.

C   YOU MEMBERSHIP

C.1 Membership Plan

Fab9 offers several Membership options, with differing levels of access to our Workspace, Equipment and Services (Membership Plans). Details of our current Membership Plans are set out in the Schedule and are available on our Website at:
https://www.fab9.com.au/memberships#options.

Fab9 may add, remove or alter the Membership Plans we offer by giving 2 months prior written notice of the changes on our Website. If you are unhappy with any proposed changes to this Agreement, contact any of our staff members and we will reasonably endeavour to address your concerns.       
You may upgrade or downgrade your Membership Plan by giving us at least 14 days' prior notice in writing.

C.2 Membership

During the Term, and subject to this Agreement, Fab9 grants you membership to the Fab9 Workspace in accordance with the benefits associated with your Membership Plan (Membership).

C.3 License

During your Membership, Fab9 grants you a non-exclusive, revocable licence to access the Premises and use the Workspace, Equipment and Services (Licence)

You acknowledge that:
No relationship of landlord and tenant is created between us and you;
we retain control, possession and management of the Workspace and you have no right to exclude us from any part of it; and
you are responsible for ensuring that the Workspace meets your needs and the needs of your business or enterprise (if relevant). We make no warranties or representations that our Workspace Equipment or Services are suitable for your intended purposes.

The Licence is subject to your ongoing compliance with:
this Agreement, particularly in relation to payment of the Fees;
your Membership Plan;
our policies and guidelines;
all reasonable directions of Fab9; and
all applicable legal obligations.

C.4 Monthly Renewal

Your Membership will be automatically renewed each month, unless:
 - your Membership is temporarily suspended in accordance with clause C.5; or
 - this Agreement is terminated in accordance with its terms.

C.5 Temporary Suspension

 - Tou may temporarily suspend your Membership by giving at least 14 calendar days' prior notice in writing before the intended suspension period will begin.
 - While your Membership is suspended, this Agreement will continue, and we will freeze any Membership Fees that fall within the suspension period.
 - Fab9 reserves the right to terminate this Agreement without further notice to you if your Membership remains suspended for 6 or more months.

D   WORKSPACE AND EQUIPMENT

D.1 Use of Workspace and Equipment

The Member must:
  • Use all Equipment safely, and in accordance with the manufacturer's operating instructions and any other instructions given by Fab9;
  • Not use the Workshop or operate Equipment under the influence of drugs or alcohol at any time;
  • Keep the Workspace in good condition, having regard to its condition on the Start Date, fair wear and tear excepted;
  • Not store or use inflammable or dangerous substances in or upon the Workspace without obtaining prior consent of Fab9 in writing;
  • Not obstruct or interfere with any of the entrances or common areas of the Workspace except as specifically permitted by Fab9;
  • Use digital fabrication equipment only for lawful purposes. No one will be permitted to use digital fabrication equipment to create material that is:
  • prohibited by local, state or federal law
  • unsafe, harmful, dangerous or poses an immediate threat to the well-being of others. (Such use may violate the terms of use of the manufacturer.)
  • in violation of another's intellectual property rights. For example, using equipment to replicate someone else's designs or articles of manufacture may infringe the copyright or patent in those materials; and
  • at the Member's cost, promptly make good any damage to the Workspace or Equipment caused by the Member, its servants, agents or representatives, that is:
  • not due to fair wear and tear caused by the ordinary use of the Workspace or Equipment; and
  • caused or contributed to by that Member's misuse of the Workspace or Equipment or the Member otherwise acting in breach of that Member's obligations under this Agreement.

D.2 Orientation

  • Fab9 may alter the Access Hours from time-to-time, at its discretion.
  • Fab9 may change the Access Hours by giving the Member 30 days written notice
  • The Member agrees to limit their daily access to areas within the Workspace as allowed in their Membership Plan and in a manner respectful of the rights of other members to fair use of the Workplace and Equipment.

D.3 Orientation

The Member will only be able to access or make use of Equipment or areas within the Workspace following an initial induction (Induction).

Bookings may be made via the Website following payment of the Membership Fee and if required, prior to the Start Date.

D.4 Access to certain equipment

  • In order to use certain Equipment within the Workspace, you may be required to undertake the Training or Assessment specified in the Schedule. Bookings and payment for these may be made via the Website.
  • Notwithstanding any Training or Assessment undertaken, the Member will only use Equipment which it has the skills and knowledge to operate.
  • Bookings in advance may be required to ensure you can access Equipment during Access Hours.
  • Use of Equipment is at no additional cost except for those specific pieces of Equipment specified in Part B of the Schedule.

D.5 Shared Workspace

The Member acknowledges that the Workspace is a shared space and that:
  • there may at times be excessive noise caused by activities in the Workspace;
  • everyone has a right to the fair use of the Workspace and Equipment, and that the Members should respect this when booking and using the Workspace and Equipment;
  • the Member will comply with Fab9's Fair Use Policy; and
  • Fab9 is not responsible for ensuring the privacy or confidentiality of the activities you conduct, or the proprietary information or materials you bring or produce.

D.6 Facilities

During long term:
  • Fab9 will provide the Equipment, internet, electricity and regular cleaning for the Workspace;
  • Fab9 may, at any time, use the Workspace and Equipment for the purposes of forums or other events.

D.7 Security

  • Despite the Workspace being lockable and the Premises having controlled access after-hours, Fab9 is not liable for the security of the Member's property.
  • Fab9 is authorised to conduct checks of the Member (for the purposes of this Agreement only) at any time, including police and credit checks.

D.8 Secure Access

  • Fab9 will provide a security access device (Keycard) to the Member that will enable access during the Access Hours and at other times at the discretion of Fab9.
  • The Member must not duplicate the Keycard or the information it contains, disclose access credentials or passcodes to any other person and must not allow any other person to use their Keycard to access the Workspace. The Member is strictly liable for any person that accesses the Workspace using the Member's credentials, passcodes or devices.
  • The Member acknowledges that a fee may apply if they require a replacement Keycard.
  • The Member agrees to return the Keycard following the end of their Membership period.

D.9 Fab9's access for works

From time to time, Fab9 may need to conduct repairs, maintenance, and other works, which may affect the Member's access to the Workspace and/or Equipment.
Fab9 will endeavour to conduct such works at times that are likely to be less frequented by members and to provide advance notice of proposed works. However, such advance notice may not always be available.
The Member agrees that:
  • Fab9 will provide a security access device (Keycard) to the Member that will enable access during the Access Hours and at other times at the discretion of Fab9.
  • The Member must not duplicate the Keycard or the information it contains, disclose access credentials or passcodes to any other person and must not allow any other person to use their Keycard to access the Workspace. The Member is strictly liable for any person that accesses the Workspace using the Member's credentials, passcodes or devices.
  • The Member acknowledges that a fee may apply if they require a replacement Keycard.
  • The Member agrees to return the Keycard following the end of their Membership period.

D.10 Policies & Guidelines

The Member must comply with all policies or guidelines provided to the Member with respect to access to the Premises use of the Workspace and Equipment.

E   FEES, PAYMENTS & SECURITY DEPOSIT

E.1 Fees

  • Our Fees may include :
  • Membership Fees;
  • Training and Assessment Fees;
  • Special Equipment Fees;
  • Storage Fees; and
  • fees and charges for any other products, services, features, contests or promotions offered by Muval from time to time.
  • The Member must pay the Fees to Fab9 without deduction or set-off. Further, Fab9 will be entitled to set off any amount owed to the Member against any amount payable by the Member to Fab9.   
  • Fab9 may, once per financial year, alter its fee structure, or increase or alter its Membership Fees. Fab9 agrees to give the Member one month notice prior to any such changes coming into effect.
  • Unless otherwise provided, all Fees and charges set out in this Agreement exclude any GST.

E.2 Training and Assessment Fees

We may charge Training and Assessment Fees in accordance with clause D.4 and as set out in the Schedule.

E.3 Storage Fees

Membership Fees do not include storage of a Member's personal items within the Workspace. Storage Fees are set out in the Schedule.

E.4 Special Equipment Fees

Membership Fees include use of all Equipment except for the following:
  • CNC routers; and
  • Laser Cutter,
(Special Equipment).
Special Equipment Fees are as published on our Website, from time to time.

E.5 Invoicing & Payment

  • The Membership Fees and any other outstanding Fees shall be paid monthly in advance on the same day as the Start Date for the subscription. If the Start Date falls on the 31st, it will renew on the 30th of the subsequent month. On leap years, the Start Date will default to the last day of the month.
  • Fab9 will provide a Tax Invoice to the Member for the Fees.

E.6 Paying by Credit Card

  • By nominating a credit or debit account, you are authorising us to deduct from that account all Fees and other charges for which you may be responsible under this Agreement. Accordingly, it is essential that you keep your account details up to date.
  • You are responsible for making sure that there is enough money in your nominated account on the usual payment day or the next Business Day if that falls on a day when banks do not process payments.
  • Any bank fees charged to us because of a rejection when we attempt to collect payments from you may be charged directly to you by us (or by the Payment Services Provider).
  • If a payment remains outstanding, you agree that, unless we are in breach of our obligations under this Agreement, we (or the Payment Services Provider) may continue to debit the nominated account for the total amount due without notice to you. If the amount owing is more than one month's Membership Fee, we will seek to contact you first.
  • If you choose to pay Fees by direct debit, then this will be through the Payment Services Provider named in the Particulars. The Payment Services Provider is not a party to this Agreement and whose only role is to provide payment services.
  • The Payment Services Provider's terms and conditions are entirely separate to this Agreement and you may have rights and obligations under those terms and conditions. As such, the Payment Services Provider acting in its capacity as such has no liability to you in connection with your involvement in exercise activities under this Agreement.

E.7 Security Deposit

  • Fab9 may require the Member to pay the Deposit or give direct debit authorisation over the value of the Deposit, prior to using the Workspace.
  • Fab9 shall be entitled to use the amount of the Deposit to remedy any breach by the Member of its obligations under this Agreement (including failure to pay) and may require the Member to repay any amounts so deducted to ensure the full amount of the Deposit is at all time available to Fab9.
  • Fab9 must refund to the Member any unused part of the Deposit within 10 Business Days of the termination of this Agreement and vacation by the Member of the Workspace.

E.8 Failure to Pay Fees

  • If the Members payment of any Fees is late, Fab9 may refuse access to Member the Premises and Workspace until such time as the Member pays all outstanding amounts.
  • If the Member does not make a payment to Fab9 by the date stated in an invoice or as otherwise provided for in this agreement, Fab9 is entitled to charge default interest on the outstanding amount at the rate of 10% per annum above the base lending rate of Commonwealth Bank, accruing daily.
  • Fab9 reserves the right to terminate this Agreement in accordance with clause G.1(b).

F   PRIVACY

F.1 Privacy Policy

We are committed to maintaining the confidentiality and security of your personal information and managing it in an open and transparent way. We take our privacy obligations very seriously and have implemented practices, procedures and systems to ensure we comply with those laws.

BY PROVIDING PERSONAL INFORMATION TO US, YOU CONSENT TO OUR COLLECTION, USE, STORAGE AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND ANY OTHER ARRANGEMENTS THAT APPLY BETWEEN US.

Fab9 reserves the right to change our Privacy Policy at our discretion. Please refer to our Website for the most current version

F.2 Photography Release

You grant to Fab9, our employees and representatives the right to take photographs of you and your property in connection with your participation in the activities or presence at and/or use of Fab9.

You authorise Fab9 to copyright, use and publish the same in print and/or electronically.

You agree that Fab9 may use such photographs of you with or without your name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

G   TERMINATION

G.1 Termination

  • Without affecting any other rights or obligations of the parties, either party may terminate this Agreement by giving not less than 20 days' prior written notice.
  • Fab9 may terminate this Agreement immediately by written notice if the Member:
  • is in breach of this Agreement and fails to rectify the breach after reasonable notice;
  • fails to comply with the reasonable directions of Fab9 or its policies and guidelines; or
  • if the Fees remain outstanding for 5 or more Business Days or are paid late for 2 or more consecutive months

G.2 Vacating the Workspace

  • Notwithstanding any other provision in this Agreement, the Member will, on expiry or earlier termination of this Agreement, make good any damage to the Workspace or Equipment caused by or contributed to by the Member prior to vacating the Workspace, at the Member's own cost.
  • The Member will not be deemed to have vacated the Workspace until it has returned the Keycard, any other access devices or keys, and complied with clause G.2(a) to the reasonable satisfaction of Fab9.
  • Upon termination, it is the Member's responsibility to update their addresses for mail, and Fab9 shall not be liable for any mail received, disposed of, opened or otherwise handled.

G.3 Effect of termination

Clauses H.1 to H.9 and clause I.1 survive termination or expiry of this Agreement, together with any other term which by its nature is intended to do so.

H   OUR LIABILITY TO YOU

H.1 Commonwealth Statutory Notice

The Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth) (CCA) provides certain guarantees in sections 60 to 62 (statutory guarantees) which generally require that services supplied to you:
  • are rendered with due care and skill,
  • are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier and might reasonably be expected to achieve any result you have made known to the supplier and
  • are supplied within a reasonable time (when no time is set).
Permitted exclusion: However, the CCA permits a supplier of recreational services to ask you to accept some limitations on those statutory guarantees. Accordingly, to the extent permitted by section 139A of the CCA, you acknowledge and agree that we exclude all liability to you for death or injury resulting from a failure by us to comply with any statutory guarantee.
In the previous sentence, "injury" means:
  • physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);   
  • the contraction, aggravation or acceleration of a disease; or
  • the coming into existence, the aggravation, acceleration or recurrence of any condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to you that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community.
Reckless conduct: This exclusion of liability does not apply if you have suffered any significant personal injury that is caused by our reckless conduct (within the meaning given to those terms by the CCA).

H.2 Victoria Statutory Notice

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012
Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that Fab9 is required to ensure that recreational services it supplies to you -
  • are rendered with due care and skill; and
  • are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
  • might reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (ACL Vic), the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the ACL Vic if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.

NOTE: The change to your rights as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the ACL Vic.

MEMBER ACKNOWLEDGEMENT

H.3 Compliance with law

Nothing in this Agreement excludes, restricts or modifies any term, condition, warranty, guarantee, right or remedy (including under a statutory guarantee) which cannot lawfully be excluded, restricted or modified.

H.4 General exclusion

Except as expressly provided in this Agreement, all implied terms, conditions, warranties, rights or other additional obligations that can be lawfully excluded are excluded from this Agreement.

H.5 No liability for death/personal injury

WE ARE NOT LIABLE FOR:

  • NEGLIGENCE; OR
  • BREACH OF TERMS IMPLIED THAT SERVICES WILL BE PROVIDED WITH REASONABLE CARE AND SKILL,

AT COMMON LAW THAT IN EITHER CASE RESULTS IN THE DEATH OR INJURY OF THE MEMBER relating in any way to:

  • the use of the Workspace or Equipment by the Member or any other person; or
  • this Agreement,
but to avoid doubt we do not exclude liability for our reckless conduct or gross negligence.

H.6 Your property

Fab9 will not be responsible or liable for any loss, theft or damage to your personal property in or about the Premises including, without limitation, any property stored at Fab9 or any proprietary information or materials.

H.7 Outside providers

Fab9 is not liable for any injury, loss or other claims arising from breach of contract, negligence or otherwise that are suffered by you in connection with any services, acts or omissions by outside providers, franchisees, contractors and other authorised persons who provide services at the Makerspace, other than to the extent caused by our negligence.

H.8 Consequential loss

We will not be liable for any indirect or consequential loss, including, but not limited to, any loss of actual or anticipated business, business interruption, income or loss of opportunity.

H.9 Liability cap

Our total liability to you for breach of this Agreement will be capped at an amount equal to the Fees paid or payable by you three months prior to the claim arising.

I   YOUR LIABILITY TO US

I.1 Your responsibility for breach and damage

The Member hereby indemnifies and shall keep indemnified Fab9 from and against all actions, claims, demands, losses, damages, costs and expenses which Fab9 may sustain or incur or for which the Member may become liable on or after the date of this Agreement in respect of, or arising from:
  • any breach by the Member of this Agreement; and/or
  • loss, damage or injury to person or property caused or contributed to by the use of the Equipment or Workspace by the Member or its staff, agents or representatives.
This indemnity survives termination of this Agreement.

J   EVENTS OUTSIDE OF OUR CONTROL

J.1 Events Out of Our Control

  • Sometimes events happen that are out of our control. These may include strikes, lockouts, accidents, fire or the delay or failure in manufacture, production, or supply by third parties of equipment or services.
  • Such events may prevent us from providing you with access to the Workspace, Equipment or Services in whole or in part.
  • In such cases both parties agree that the other party will not be liable for any delay or failure in performing their obligations while such events persist.
  • Either party may cancel this Agreement if the delay or failure referred to above continues for a period of 2 months or more.

K   GENERAL PROVISIONS

K.1 General

  • Amendment: The parties may amend the terms of this Agreement, or make any new terms subject to this Agreement, by agreement in writing.
  • Assignment: The Member may only assign or otherwise create an interest in their rights under this Agreement with the express written consent of Fab9. Fab9 may assign this Agreement upon written notice to the Member.
  • Electronic communication: Agreement, consent, notice or communication under this Agreement is effective if it is sent as an electronic communication (within the meaning of the Electronic Transactions Act 1999 (Cth) unless required to be physically delivered under law.
  • Disclaimer: Each party acknowledges that it has not relied on any representation, warranty or statement made by any other party, other than as set out in this Agreement.
  • Waiver: No clause of this Agreement will be deemed waived and no breach excused unless such waiver or consent is provided in writing.
  • Further assurances: Each party must do anything necessary (including executing agreements and documents) to give full effect to this Agreement and the transaction facilitated by it.
  • Governing Law: This Agreement is governed by the laws of the state of Victoria, Australia. Each of the parties hereby submits to the non-exclusive jurisdiction of courts with jurisdiction there.
  • Expenses: Each party must pay its own expenses incurred in entering into this Agreement.
  • Time: Time is of the essence in this Agreement.
  • Severability: Any clause of this Agreement, which is invalid or unenforceable is ineffective to the extent of the invalidity or unenforceability without affecting the remaining clauses of this Agreement.

MEMBERSHIP PLANS AND FEES SCHEDULE

PART A: Membership Plans and Fees

Prices set out below are inclusive of GST.

PART B: Training and Assessment Fees

Site tours, Orientations, Training and Skill Assessments can all be booked via the Website or Fab9 Eventbrite page.

Use of the following equipment requires a booking and payment of the relevant fee and successful completion of the training session and/or assessment:

1. Timber Shop

Inductions and assessment must be completed in the following areas:

Timber Shop —  jointer, thicknesser, router table,  table saw, mitre saw, band saw, scroll saw, Timber Lathe.
Power tools, hand tools & finishing  —  oscillating belt sander, domino, drill press and an array of drills and hand tools;

2. Laser Cutter, 3D Printer and Electronics Equipment Safety

3. Multicam Trident CNC router

Use of the router requires induction before use. The course will take you through the CNC basics, such as CAD/CAM, G code (machine code), selecting cutters, and working with different materials. This course costs $250.

4. One-on-one training

Individual training with technical staff is offered at an hourly rate of $90 charged in thirty minutes increments.


PART C: Fees for Use of Special Equipment

Membership Fees include use of all Equipment except for the following:
MCNC routers - $12.50 per 15 min / $50 per hour; and
Laser cutters - $6.25 per 15 min / $25 per hour

Special Equipment Fees are as published on our Website, from time to time.

PART D: Storage Fees

SCHEDULE - FAIR USE POLICY


1. Background

This Fair Use Policy applies to your access of the Workshop and Equipment. The Policy is intended to ensure that:
all Members have fair and equitable opportunity to access and use the Workspace and Equipment in accordance with their Membership Plan; and
the Workspace and Equipment are not used in an unreasonable manner.

We reserve the right to vary the terms of this Fair Use Policy from time to time.

Unless otherwise indicated, capitalised terms used in this Fair Use Policy have the meanings given to them in our Membership Agreement with you.

2. Fair Use

  • You are responsible for clearing those parts of the Workspace and those items of Equipment which you use. All Equipment must be packed up and put away in its designated area after use to minimise risk and injury to other Members and staff.
  • You must not attempt to fix any damaged or out-of-order Equipment yourself.
  • In using the Workspace or Equipment, please be considerate of other Members and of Fab9 staff and minimise your noise.
  • All members must access the building with their own access key. You must not allow non-Members to access the Workspace without Fab9s express consent.
  • Members must only use the parts of the Workspace and Equipment that are within their Membership Plan, unless otherwise authorised by Fab9.
  • For your safety and the safety of others, Members are expected to immediately report any accidents, incidents, problems with the Services, Equipment or the Workspace
  • Do not use mobile phones or other electronic equipment while using the Equipment.
  • Misuse of emergency procedures will result in a fine and suspension of membership.
  • For any Equipment for which a booking is required, you must arrive promptly at the beginning of your scheduled booking time, and leave immediately at the end.
  • If you are no longer able to attend a booking you have made, please contact us to cancel the booking.
  • You must not make multiple bookings under different names.
